1. Acceptance of Terms

By downloading, installing, or using the Tensly mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, do not use the App.

2. Description of Service

Tensly is a wellness and self-awareness tool that monitors your nervous system state using heart rate variability (HRV) and heart rate data from Apple Watch.

What Tensly Does:

• Learns your personalized physiological baseline over 7 days
• Detects real-time nervous system states (calm, elevated, under pressure, high strain)
• Provides gentle notifications when sustained strain is detected
• Displays daily patterns and insights

What Tensly Does NOT Do:

• ❌ Diagnose, treat, cure, or prevent any disease
• ❌ Provide medical or mental health advice
• ❌ Replace professional healthcare services
• ❌ Guarantee specific health outcomes

Tensly is not a medical device and is not regulated by the FDA or equivalent regulatory bodies.

3. Medical Disclaimer

3.1 Not Medical Advice

The information provided by Tensly is for informational and wellness purposes only. It does not constitute medical advice, diagnosis, or treatment.

Always seek the guidance of a qualified healthcare provider with any questions you may have regarding a medical condition or mental health concern.

3.2 No Clinical Use

Tensly is not intended for:

• Clinical diagnosis of autonomic disorders
• Monitoring of medical conditions
• Emergency response or crisis intervention
• Professional healthcare decision-making

3.3 Emergency Situations

3.4 Accuracy Limitations

Tensly reflects physiological patterns based on Apple Watch sensor data. Accuracy depends on:

• Proper Watch fit and wear
• Sensor quality and calibration
• Movement and environmental factors
• Individual physiological variability

Results are not diagnostic. They reflect your body's state at a given moment — not a clinical assessment.

3.5 User Responsibility

You acknowledge that:

• You are responsible for how you interpret and act upon the information provided
• Tensly's insights are educational and exploratory, not prescriptive
• You will consult healthcare professionals for medical or mental health decisions

4. Eligibility

4.1 Age Requirement

You must be at least 13 years old to use Tensly.

If you are between 13 and 18, you must have parental or guardian consent.

4.2 Device Requirements

Tensly requires:

• iPhone running iOS 17.0 or later
• Apple Watch Series 4 or later running watchOS 10.0 or later
• Active Apple Watch pairing and HealthKit permissions

5. Account & Subscription

5.1 Free Baseline Period

The first 7 days are provided as a free trial. During this time:

• You complete baseline learning while experiencing the full app
• Full insights activate after baseline is established
• No payment is required during the trial

You will not be charged until day 8. Cancel anytime during the trial at no cost.

5.2 Tensly Premium

After the 7-day free trial, you may continue with Tensly Premium to maintain full access to:

• Real-time state detection and insights
• Personalized intervention suggestions
• Daily pattern tracking and history
• Optional nudge notifications

Pricing: $4.99/month (USD) or equivalent in your local currency.

Billing: Subscription is processed through Apple's App Store. Payment is charged to your Apple ID at confirmation of purchase.

Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

5.3 Cancellation

You can cancel your subscription anytime:

1. Open iPhone Settings → [Your Name] → Subscriptions
2. Select Tensly Premium
3. Tap Cancel Subscription

Cancellation takes effect at the end of your current billing period. You retain access until then.

No partial refunds are provided for unused portions of a billing period.

5.4 Refund Policy

Refunds are handled by Apple, not Tensly.

To request a refund:

1. Visit reportaproblem.apple.com
2. Sign in with your Apple ID
3. Select Tensly Premium and request a refund

Apple decides whether to grant refunds on a case-by-case basis.

5.5 Subscription Changes

We reserve the right to:

• Modify subscription pricing (changes apply to new subscribers or upon renewal)
• Add or remove features from Premium tier
• Discontinue the subscription service (with 30 days notice)

You will be notified of significant changes via in-app alert or email (if provided).

6. User Conduct

You agree to use Tensly only for lawful, personal, non-commercial purposes.

Prohibited Uses:

You may not:

• ❌ Reverse-engineer, decompile, or modify the App
• ❌ Use the App for clinical or medical decision-making
• ❌ Share your subscription access with others
• ❌ Extract or scrape data from the App for external use
• ❌ Use the App to violate any laws or regulations
• ❌ Attempt to hack, disrupt, or damage the App or Apple's services

Violation of these terms may result in immediate termination of your access.

7. Intellectual Property

7.1 Ownership

Tensly, including all software, design, content, and branding, is owned by 3nsofts and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal purposes.

7.2 Restrictions

You may not:

• Copy, modify, or distribute the App
• Create derivative works based on the App
• Remove or alter any copyright or trademark notices
• Use the Tensly name or logo without permission

7.3 User Data Ownership

You retain ownership of your health data. We do not claim rights to your personal information.

8. Privacy & Data Protection

Your use of Tensly is governed by our Privacy Policy.

Key points:

• ✅ All health data stays on your device (never uploaded to servers)
• ✅ No tracking, analytics, or advertising
• ✅ You control all permissions via iOS Settings

9. Third-Party Services

Tensly integrates with Apple services:

9.1 Apple HealthKit

• Used to access heart rate, HRV, sleep, and mindfulness data
• Governed by Apple's Privacy Policy

9.2 Apple StoreKit

• Used to process subscription payments
• Governed by App Store Terms & Conditions

9.3 Apple Watch

• Required for continuous health monitoring
• Data syncs locally via Bluetooth (no internet connection needed)

We are not responsible for Apple's policies, service availability, or data handling.

10. Disclaimer of Warranties

Tensly is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.

We disclaim all warranties, including but not limited to:

• Merchantability — Fitness for a particular purpose
• Accuracy — Correctness or reliability of data or insights
• Non-Infringement — Freedom from third-party claims
• Availability — Uninterrupted or error-free service

We do not guarantee:

• ✗ Continuous or error-free operation
• ✗ Compatibility with all devices or iOS versions
• ✗ Specific health outcomes or benefits
• ✗ Accuracy of Apple Watch sensor data

Use Tensly at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, 3nsofts and its developers shall not be liable for:

• Direct, indirect, incidental, consequential, or punitive damages arising from your use of Tensly
• Personal injury, health issues, or medical emergencies resulting from reliance on the App
• Loss of data, profits, or business opportunities
• Device malfunction or compatibility issues
• Apple service outages or HealthKit errors

Our total liability to you for all claims shall not exceed the amount you paid for Tensly in the 12 months preceding the claim.

Some jurisdictions do not allow limitation of liability for personal injury or certain damages. In such cases, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify and hold harmless 3nsofts, its developers, and affiliates from any claims, damages, or expenses (including legal fees) arising from:

• Your use or misuse of Tensly
• Your violation of these Terms
• Your violation of any third-party rights
• Reliance on Tensly for medical or healthcare decisions

13. Updates & Modifications

13.1 App Updates

We may release updates to improve functionality, fix bugs, or add features.

Updates may:

• Require you to accept new Terms or permissions
• Change how certain features work
• Deprecated older iOS or watchOS versions

You are responsible for keeping the App updated to the latest version.

13.2 Changes to Terms

We may modify these Terms at any time.

When we make changes:

• We will update the "Last Updated" date at the top
• Significant changes will be communicated via in-app alert
• Continued use of the App constitutes acceptance of updated Terms

If you do not agree to updated Terms, you must stop using the App and cancel your subscription.

14. Termination

14.1 By You

You may stop using Tensly at any time by:

• Deleting the App from your iPhone and Apple Watch
• Canceling your subscription (if active)

14.2 By Us

We may terminate or suspend your access if:

• You violate these Terms
• You engage in prohibited conduct (fraud, hacking, abuse)
• We discontinue the service (with 30 days notice)

Termination does not entitle you to a refund for any unused subscription period.

15. Geographic Restrictions

Tensly is available for download in all regions where the Apple App Store operates.

However:

• Certain features may not be available in all countries
• Subscription pricing varies by region
• Local laws may impose additional restrictions

You are responsible for complying with local laws in your jurisdiction.

16. Governing Law & Dispute Resolution

16.1 Governing Law

These Terms are governed by the laws of the jurisdiction in which 3nsofts operates, without regard to conflict of law principles.

16.2 Dispute Resolution

Before filing a lawsuit, you agree to attempt to resolve disputes informally by contacting us at support@3nsofts.com.

If informal resolution fails:

• You agree to submit disputes to binding arbitration (if legally permitted in your jurisdiction)
• Arbitration will be conducted by a neutral arbitrator
• You waive the right to a jury trial or class action

Exception: You may bring claims in small claims court if they qualify under local rules.

16.3 Class Action Waiver

You agree to resolve disputes individually, not as part of a class, consolidated, or representative action.

17. Miscellaneous

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and 3nsofts regarding Tensly.

17.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect.

17.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

17.4 Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights to a successor entity.

17.5 Force Majeure

We are not liable for delays or failures caused by events beyond our control (natural disasters, pandemics, government actions, Apple service outages).
